RiseCraft, LLC (dba DocuRise) ("DocuRise," "we," "us," "our") provides document security, viewer analytics, lead generation, digital document sales, and automated messaging tools (collectively, the "Service"). Our Privacy Policy, Data Processing Addendum (DPA), and Acceptable Use Policy (AUP) are incorporated by reference into these Terms.
You must be at least 18 years old to use the Service. You are responsible for all activity under your account and for keeping your credentials secure. If you register on behalf of an entity, you represent that you have authority to bind that entity. We may request documentation to resolve account ownership disputes.
3.1 Data Roles. You are the Data Controller for personal data collected from your viewers and leads. RiseCraft, LLC is the Data Processor. We are not a party to transactions between you and your leads.
3.2 Messaging Compliance. You are solely responsible for complying with the CAN-SPAM Act and all applicable laws governing commercial messages sent through the Service, including obtaining opt-in consent from recipients. This applies to all messaging channels — email, direct messages, and social media.
3.3 Lead Collection Compliance. When you use the Service to collect personal information from viewers (e.g., through lead capture forms), you are solely responsible for: (a) providing viewers with your own privacy notice that explains how their data will be used; (b) obtaining all necessary consents required by applicable law before using viewer data for marketing or other purposes; and (c) honoring any opt-out or data deletion requests from your viewers. RiseCraft, LLC is not responsible for your compliance with data protection laws as they relate to the personal data you collect through the Service.
You retain ownership of content you upload ("User Content"). By uploading, you grant RiseCraft, LLC a limited, non-exclusive, royalty-free license to host, store, transmit, display, and cache your User Content solely to provide the Service. This license ends when you delete the content or your account.
RiseCraft, LLC retains all rights to the Service itself, including its software, design, and trademarks.
You are solely responsible for configuring document security settings. We do not pre-screen content and are not liable for unauthorized access resulting from your configuration choices. Analytics are provided "AS IS" — we do not guarantee accuracy due to VPNs, ad-blockers, or browser settings.
The Service may integrate with third-party platforms (e.g., Instagram). Your use of these integrations is also subject to those platforms' terms. You are solely responsible for complying with their rules. We are not liable for account suspensions, restrictions, or loss of functionality imposed by third-party platforms.
7.1 Digital Sales. We are not the seller of record for content you sell. Payment processing is provided by Stripe under the Stripe Connected Account Agreement. We are not liable for Stripe's performance or errors. You are solely responsible for applicable taxes and your own refund policy.
7.2 Subscriptions. YOUR SUBSCRIPTION AUTOMATICALLY RENEWS UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. You may cancel anytime via account settings; access continues until the end of the current billing period. Fees are non-refundable unless required by law. Prices may change with 30 days' notice. If payment fails, we may suspend access to paid features.
If you believe content on DocuRise infringes your copyright, send a DMCA-compliant notice to dmca@docurise.io. We will process takedown and counter-notification requests in accordance with 17 U.S.C. § 512. We may terminate accounts of repeat infringers.
You may close your account anytime. We may suspend or terminate your account immediately for violation of these Terms or the AUP, or for any other reason with 30 days' notice. Upon termination, we may delete your User Content after a reasonable period. Sections 4, 10, 11, 12, 13, and 15 survive termination.
You agree to indemnify and hold RiseCraft, LLC harmless from any claims, losses, and legal fees arising from your use of the Service, your User Content, or your violation of these Terms or any law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISECRAFT, LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. These limits do not apply to liability arising from willful misconduct or gross negligence.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.1 Governing Law. Delaware law governs these Terms.
13.2 Arbitration. Disputes shall be resolved by binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules. We will pay AAA filing fees for claims under $10,000 unless found frivolous. Either party may bring claims in small claims court instead. You may opt out of arbitration by emailing support@docurise.io within 30 days of accepting these Terms.
13.3 Class Action Waiver. CLAIMS MAY ONLY BE BROUGHT ON AN INDIVIDUAL BASIS, NOT AS PART OF ANY CLASS OR REPRESENTATIVE ACTION.
We may update these Terms with 30 days' notice. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Service.
If any provision is unenforceable, the rest remain in effect. These Terms (including the Privacy Policy, DPA, and AUP) are the entire agreement between you and RiseCraft, LLC. You may not assign your rights under these Terms without our consent; we may assign ours without restriction.
